In a metropolis as large as New York City, there is a compelling interest to take the necessary steps to protect the environment. Apropos to this public purpose, one needs to be aware that Environmental Control Board Liens can be rendered by the Environmental Control Board for matters involving: air/water pollution, harbor maintenance, street cleaning, sewer maintenance and/or construction as well as vacant lot safety. The statutory authority for the Environmental Control Board to act can be found in the New York City Charter. In particular, one should look to Chapter 57, §§ 1401 thru 1404 and 1049-a.
